The Terms and Conditions aim, on the one hand, to inform any customer about the conditions and how the seller sells and delivers the ordered products, and on the other hand, to establish the rights and obligations of the parties in the process of selling the products by FERAE NATURAE to the consumer (hereinafter referred to as "Buyer"). These conditions apply without restrictions or reservations to all buyers of products marketed by FERAE NATURAE. Therefore, the fact that a buyer orders a product marketed in our online store implies the full and complete acceptance of the terms and conditions of sale, which the buyer declares to have known prior to placing the order.

Article 3 - Contract conclusion and orders

3.1 Rates

The online selling price of the products in our online store, expressed in Euros (EUR), is the one in force at the time of placing the Order by the Buyer. The sale price of the products can be changed at any time, but in no case can the price be changed after placing the order, unilaterally. This change will be communicated to the Buyer before any Order. The prices apply to distance selling.

These prices do not include the shipping costs, which will be charged separately, in addition to the price of the purchased products. Shipping costs will be indicated before the Purchase Order is registered. The different shipping methods are provided and taken on the site; these can be modified at any time by FERAE NATURAE. Prices include value added tax (VAT) applicable on the day of order registration. Any change in the VAT rate will automatically apply to the price of the products sold by FERAE NATURAE.

3.2 Product characteristics

The buyer can select one or more products from the different categories presented in the online store.
FERAE NATURAE may at any time modify the assortments of products offered for sale, in particular according to the constraints related to its suppliers, without prejudice to the Orders already registered by the Buyer. The buyer may, before placing the Order, inform himself on the FERAE NATURAE website about the essential characteristics of the product (s) he or she wishes to order. All the products comply with the legislation in force in Romania. The information on the product packaging will be available at least in Romanian.

3.3 Availability

The offers presented by FERAE NATURAE are valid as long as they are displayed in the online store, within the limits of the available stocks.

3.4 Order

Any Order implies acceptance of the Terms and Conditions. From the moment the Buyer confirms the order it is considered that he has accepted in the knowledge of the cause the content and conditions of the respective Order and, in particular, the Terms and Conditions, the fact that the Order implies an obligation of payment from him, the prices, volumes, characteristics, the quantities and the delivery time of the products marketed and ordered by the Buyer.
After validating this step, the Buyer will only be able to cancel the Order on the basis of the right of renunciation provided by art. 6 below. The sale will be final (subject to the Buyer exercising his right of withdrawal, under the conditions provided for in Article 6 of the Terms and Conditions).

The order will be confirmed by FERAE NATURAE by sending an electronic information to the Buyer.
A second e-mail will be sent to the Buyer at the time of order delivery. At this time, FERAE NATURAE will be entitled to charge the order price. FERAE NATURAE recommends to the Buyer to keep the two electronic messages on paper or computer. The Buyer is informed that the two electronic messages will be sent to the e-mail address indicated by the Buyer at the time of registration or identification, prior to placing the Order.

FERAE NATURAE will be entitled to charge the total price for the Order:
- for the payments made according to article 4.1 below: immediately after sending the electronic message informing the Buyer about the shipment of his Order;
- for payments made in the reimbursement system: at the time of delivery of the package, FERAE NATURAE having the right to refuse the delivery of the parcel in case the Buyer does not pay the price of the ordered products.

Therefore, in case of error in mentioning the e-mail address or of not receiving the electronic message to confirm the Order, FERAE NATURAE will not be liable. In this case, the sale will be considered final, except in cases of cancellation of the Order by FERAE NATURAE, especially for the unavailability of the products under the conditions mentioned above. However, the Buyer will be able to exercise his right of withdrawal, under the conditions provided in Article 6 of the Terms and Conditions.

FERAE NATURAE reserves the right to suspend or cancel the execution of any Order and / or delivery, regardless of the nature or stage of its execution, in case of non-payment or partial payment of any amounts due by the Buyer, in case of payment or fraud or attempted fraud in connection with the use of the online store, including during previous Orders.

 

Article 4 - Payment

4.1 Payment instruments

When registering the Order, the Buyer guarantees FERAE NATURAE that it has the necessary authorizations to use the payment instrument chosen for its Order.

4.1.1 Bank cards

The bank cards accepted in the FERAE NATURAE online store are the following: Visa and Mastercard, including Maestro or Visa Electron . The card payment is made through the online payment operator NETOPIA mobilPay ( www.mobilpay.ro ).

4.1.2 Refund (cash at courier)

This method of payment implies the payment of the order at the time of delivery of the parcel, issuing the receipt by the courier company.

4.2 Methods of payment

Depending on the payment method chosen, the payment must be made when placing the Order online by the Buyer in the case of payments by bank card, respectively at the time of delivery of the parcel in the case of the repayment payment.

In case of difficulty when making the payment, the Buyer may call the bank institution issuing the bank card.

All Orders are payable in RON (RON), with all taxes and mandatory contributions included.

At the discretion of FERAE NATURAE, delay penalties, equal to the legal interest rate, may be applied to the amounts not paid at the expiration of a period of ten days from the date of the Order or from the date of notification of the rejection of the bank payment.
In addition, FERAE NATURAE reserves the right to suspend or cancel the execution of any Order and / or delivery, regardless of the nature or stage of its execution, in case of non-payment or partial payment of any amounts due by the Buyer, in case of payment incident or fraud or attempted fraud in connection with the use of the online store, including on previous Orders.

4.3 Security of payment transactions

In the fight against offenses committed on the Internet, information regarding the Purchase Order may be transmitted to any third party authorized by law or designated by FERAE NATURAE, solely for the purpose of verifying the Buyer's identity, the validity of the Order, the payment method used and the delivery made in view. Following this check, FERAE NATURAE will have the right to request a photocopy of the Buyer's identity card and / or any information about the Buyer's identity. Any Buyer has the right of access, rectification and deletion of the personal data concerning him and which are processed by FERAE NATURAE, under the conditions stipulated in the documents "Privacy policy" and "Policy on the use of cookies".

Article 5 - Delivery and reception

5.1 General rules

The products ordered by the Buyer will be delivered to the address indicated by the Buyer as the delivery address for the respective Order ("Delivery address").
The purchase invoices are sent by electronic message to the e-mail address indicated by the Buyer at the time of its registration in the online store or in paper format, together with the Order.

5.2 Characteristics of the delivery methods of the Site

The orders are delivered through DYNAMIC PARCEL DISTRIBUTION SA, hereinafter "DPD".
At the time of delivery, the delivery is made by the DPD foreman to the Purchaser or the recipient of the Order, and the latter signs a confirmation of receipt. This confirmation of receipt proves the delivery by FERAE NATURAE and the receipt by the Buyer or the recipient of the Order of the ordered products.

The parcel delivery itself cannot be disputed if the parcel appears to have been delivered, the carrier's print screen proving this fact.

By agreeing to the Terms and Conditions, the Buyer agrees and empowers the carrier that, in case the Buyer himself or the consignee of the delivery is not present at the address indicated for the delivery, to send the parcel to any of the persons in its premises.

The cost of delivery is 15 (fifteen) lei for orders up to 200 (two hundred) lei. In the case of orders with a value of more than 200 (two hundred) lei, the Buyer benefits from free delivery.

5.3 Anomaly, damage, damaged package

The buyer or the consignee of the Order is requested to check the apparent condition of the parcel and the products at the time of delivery.

In case of anomaly regarding the parcel (damaged parcel, open parcel, traces of liquid, etc.) or to the ordered product (s) (missing product), damaged product (s), Buyer or consignee The order must be made known at the time of delivery to the representative of the alleged DPD, failure to comply with the appropriate procedure excludes the possibility of any claim against the carrier and FERAE NATURAE, in particular, the Buyer will not be able to claim any refund of any amount or the buyer. Orders will not even be able to claim FERAE NATURAE to deliver the ordered products again.

5.4 Delivery times

In the case of delivery by DPD, a delivery of the purchased products will be attempted within approximately 3-5 working days from the conclusion of the sale - purchase contract. In duly justified cases, the delivery time may be a maximum of 30 (thirty) days from the conclusion of the contract. The delivery times start to run from the date of conclusion of the sales contract, namely the transmission of the electronic message to confirm the Order.

 

Article 6 - Rights and deadlines for withdrawal

6.1 The right and the legal term of withdrawal

6.1.1 The term for exercising the legal right of withdrawal

In accordance with Article 9 (1) of the Emergency Ordinance no. 34/2014 regarding the rights of consumers in the contracts concluded with professionals, the Buyer has a period of 14 (fourteen) days from the date on which the Buyer or a third party, other than the carrier, indicated by the Buyer, enters the physical possession of the products , to exercise their legal right of withdrawal, without being obliged to justify their decision.

6.1.2 Methods of exercising the legal right of withdrawal

The buyer or, as the case may be, the recipient of the Order, in order to exercise his right of withdrawal, must inform FERAE NATURAE expressly about his decision to withdraw from this contract, using an unequivocal statement, for example, a letter sent by post or email. To comply with the withdrawal deadline it is sufficient for the Buyer to send the communication regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

6.1.3 Products exempted from exercising the legal right of withdrawal

According to article 16 of the Emergency Ordinance no. 34/2014 regarding the rights of consumers in the contracts concluded with the professionals, the right of withdrawal cannot be exercised for the Orders that refer to:
- the supply of goods that have been unsealed after delivery, which can no longer be returned for hygiene or protection reasons of health;
- supply of goods made according to the consumer's specifications or obviously personalized.

Therefore, the Buyer is aware that it will not be able to take advantage of its legal right of withdrawal regarding the products sealed by him, whose new commercialization by FERAE NATURAE could present risks due to hygiene or health protection reasons. consumers (for example: body care, makeup products, etc.).

6.1.4 Consequences of exercising the legal right of withdrawal

In the event that the products may be subject to the legal right of withdrawal, the Buyer exercising the right of withdrawal under the conditions provided for in this article regarding the terms and methods of return of the products, will be able to obtain the refund of the value of the returned products, as well as the shipping costs. related to the Order. The buyer or the consignee of the Order exercising his legal right of withdrawal under the conditions provided for in this article regarding the terms and modalities of the return of the Products, will be reimbursed all the amounts paid to FERAE NATURAE by way of payment for the order on which he was exercised the right of withdrawal, excluding delivery costs, without undue delay, and in any case, not later than 14 (fourteen) days from the date on which FERAE NATURAE is duly notified of the decision to withdraw from this Agreement. Pursuant to art. 13 (2) of the Emergency Ordinance no. 34/2014 regarding the rights of the consumers in the contracts concluded with the professionals, the Consumer understands and expressly gives his consent that the reimbursement of the amounts should be made exclusively by bank transfer, meaning that he is obliged to provide FERAE NATURAE the data of a bank account for the transfer of the amounts. In any case, the Consumer will not receive any fees as a result of such reimbursement. FERAE NATURAE has the right to postpone the refund until the date it receives the products back. The returned products will be shipped by the Buyer to FERAE NATURAE ..

6.1.5 Expenses

According to article 14 (2) of the Emergency Ordinance no. 34/2014 regarding the rights of consumers in the contracts concluded with the professionals, the costs of returning the products will be borne by the Buyer. By exception, in cases of inconsistency between the delivered products and the Order the return expenses will be borne by FERAE NATURAE.

6.2 Methods of exercising the legal right of withdrawal and the contractual right of withdrawal

6.2.1 General provisions applicable to the return of products

It is obligatory for the products to be returned to FERAE NATURAE in a state that allows them to be put back on sale (products in perfect condition together with the original packaging intact, accessories, prospectuses, hologram, etc.) at the latest, as the case may be, within 14 (fourteen) days respectively 30 (thirty) days from the date on which the Buyer or a third party, other than the carrier, indicated by the Buyer, enters into physical possession of the products.

Product returns sent after this deadline are not accepted.

In addition, the products will be accompanied by the Order number, mentioned either on the Return Voucher, sent along with the delivered products, signed by the Buyer or the recipient of the Order, or on any other document. The Purchaser and the recipient of the Order, if different from the Purchaser, are informed that the use of the Return Voucher facilitates the processing of the return by FERAE NATURAE. The Buyer or the recipient of the Order, if it differs from the Buyer, is therefore asked to use the Return Voucher.
In the event that the Buyer has benefited from a special offer on the Site, which allowed him, under certain conditions, to purchase one or more products offered in exchange for his Order or to benefit at no additional cost from different promotional samples, it will be considered as through the exercise of his right of withdrawal is no longer eligible to benefit from the respective offer or the respective samples. The buyer will have to return the product (s) he wishes to return only with the samples received respectively the product (s) purchased on offer in exchange for the order of the product (s) returned, so that FERAE NATURAE can respond to the request its withdrawal.

The buyer will be responsible for diminishing the value of the products resulting from their handling, different from what is necessary to determine the nature, characteristics and, as the case may be, the functioning of the products.

6.2.2 Return the parcel by courier

In addition to the conditions set out in Article 6.2.1 of the Terms and Conditions of Sale, the Purchaser or the consignee of the Order, who wishes to exercise his right of withdrawal, legally or contractually, returning the product by courier / parcel, must follow the following instructions:
- it is obligatory to use the original packaging for the return of the product (s) concerned;
- sending the parcel with acknowledgment of receipt to the following address: Sacele - Str. Dumpster 68A. Sc.A, Ap.8, Jud. Brasov, recipient of SC FERAE NATURAE SRL.

FERAE NATURAE does not accept parcels addressed improperly, at any other work point or address, even if FERAE NATURAE belongs.

When the Purchaser / Consignee of the Order does not prove that he has actually delivered the product to a carrier according to the above, all risks related to the return of the product are the responsibility of the Purchaser or the consignee of the Order.

 

Article 7 - Guarantees

7.1 Legal guarantees

The products sold are covered by a warranty given by the manufacturer or supplier.

Article 8 - Client's responsibility for placing individual content on the site

By posting reviews on the online store's website, the Customer voluntarily distributes content. The seller does not respond to the publications posted by customers, because this responsibility is not included in his activity.

The seller is not responsible for the content placed by the customers, noticing their violations.

It is forbidden for the Customer to post on the website of the online store content that could:

  1. a) be placed in order to infringe the personal rights of other consumers;
  2. b) to violate the rights related to protection, industrial property, trade secret or confidentiality obligations;
  3. c) to use uncensored and offensive language towards other consumers;
  4. d) to oppose the Seller's interests.

The customer is obliged to use the Store in accordance with the applicable law, the provisions of this Regulation, in particular not to provide illegal content, to violate the generally accepted social norms or to cause the interruption of the activity or the overloading of the IC systems on the website of the Store.

The Seller reserves the right to modify or delete the content posted by the customers, in case it may constitute a violation of the applicable regulation or law.

If the Customer or another entity establishes that the content published on the shop's website does not respect its personal, moral rights, being in opposition to the regulation, it may report to the seller a possible violation.

The seller resolves any violations by taking immediate action to remove the offending or inappropriate content.

 

Article 9 - Termination of the contract

Both the Customer and the Seller may terminate the contract for the provision of electronic services at any time and without motivation, subject to the preservation of the rights acquired by the other party before the termination of the aforementioned contract.

The client who made the registration terminates the contract for the provision of electronic services by sending to the Seller an appropriate declaration of intent, using any means of distance communication.

The seller interrupts the contract for the provision of electronic services by sending a declaration of intent to the e-mail address entered by the Customer during the registration.
